When you order a cake you are buying a fresh, made-to-order product. Because cakes are perishable, and bespoke cakes are made to your specification, you do not have the usual 14-day right to change your mind that applies to most online purchases. You still have your full rights if a cake arrives faulty, unsafe or not as described. The details are below, and they apply from the moment you place an order.
Who you are buying from
These terms are between you and Tinu Shibin trading as Vivi's Cakery, of 25E Oak Hill Park, Liverpool, L13 4BL.
Business structure: Sole trader.
Companies House number: Not applicable — Vivi's Cakery is a sole trader, not a registered company.
VAT status: Not VAT-registered. No VAT is added to or included in our prices — the price shown is the total you pay. We cannot issue a VAT invoice; you receive a payment receipt from Stripe and an order confirmation email from us.
Food business registration: Vivi's Cakery is registered as a food business with Liverpool City Council, and has been registered since 2024.

Placing an order
Choosing a cake and paying places an order, but the contract between us is formed when we send you an order confirmation email. If we cannot make your cake — because the date is full, or the design is not something we can do safely — we will tell you and refund you in full.
Orders must be placed at least 3 days before the date you need the cake. Bespoke cakes need considerably longer; we will agree a lead time with you when we quote.
There is a minimum order value of £25.00.
Prices and payment
Prices are shown in pounds sterling and include VAT where it applies. Menu cakes are paid in full at checkout, through Stripe. We never see or hold your card details.
Bespoke cakes are quoted individually. Your quote is valid for the period stated on it. Once you accept, payment is made through the payment link we send you.
Changes to your order
Tell us as early as you can. We will always try to accommodate a change of date, flavour or inscription, but once we have started baking or bought ingredients specifically for your cake, changes may not be possible and may incur a cost.
Cancelling: your right to change your mind
For most things bought online you get 14 days to change your mind, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. That right does not apply to our cakes, for two reasons set out in those same Regulations:
- They are perishable. Regulation 28(1)(c) removes the cancellation right for goods liable to deteriorate or expire rapidly. A fresh cream and buttercream cake plainly does.
- They are made to your specification.Regulation 28(1)(b) removes it for goods made to the consumer’s specifications or clearly personalised. That covers every bespoke cake, and any menu cake carrying an inscription you chose.
We are telling you this before you order because the law requires us to. We cannot rely on those exemptions unless we have.
What we will do anyway
Although we are not obliged to, we would rather be reasonable than technically correct:
- Cancel more than 7 days before your date and we will refund what you paid, less any ingredients already bought specifically for your cake.
- Cancel between 7 days and 48 hours before, and we will refund half.
- Inside 48 hours the cake is usually already made, and we cannot refund it.
If something serious has happened, tell us. We are a small bakery and we will use judgement.
If something is wrong with your cake
Nothing above affects your rights under the Consumer Rights Act 2015. Your cake must be of satisfactory quality, fit for purpose and as described. If it is not, you are entitled to a repair, replacement or refund, and none of the cancellation exemptions above change that.
Please tell us within 24 hours of delivery and send a photograph if you can, so we can see what went wrong while the evidence still exists. See our returns and refunds page for how that works in practice.
Allergies
All our cakes are made in a kitchen that handles the fourteen regulated allergens and we cannot guarantee any cake is free from any of them. You must tell us about any allergy before ordering. Please read our allergen information first.
Photographs of your cake
We may photograph cakes we have made and use those photographs to show our work, including on Instagram and this website. We will never publish your name, the inscription on a personal cake, or anything else that identifies you, without asking you first. Tell us if you would rather we did not photograph your cake at all and we will not.
Liability
Our responsibility is limited to the price you paid for the cake. We are not liable for indirect losses, such as the cost of an event. Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — which includes our obligations around food safety.
Complaints and law
Email us first — most things are fixable. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
